Plan for continuity before moving: communicate the new address, anticipated date, and current services. Distinguish a school change within the DEPR from transfer between public agencies or jurisdictions; not every municipal move triggers the same federal procedure.
Transfers between agencies
For a student with a current IEP enrolling in another agency during the same school year, §300.323(e)–(f) requires FAPE, including comparable services in consultation with parents. Within the same jurisdiction, this continues until the prior IEP is adopted or a new one implemented. From another jurisdiction, the agency determines whether evaluation is necessary and develops a new IEP as appropriate.
Coordinate school, records, and services
Request transfer instructions and current forms; the SAEE catalog is a starting point. Keep the IEP, evaluations, approvals, provider information, and transportation details. Confirm who will coordinate each service and its start date. Section 300.323(g) requires prompt agency efforts to obtain and transmit records.
If the program is interrupted
Document enrollment, communications, missed services, and effects on the student. A move should not be handled as though an IEP never existed. Transfer continuity differs from stay put during a dispute. We can review the applicable rule and steps to restore the program.
The answer for your situation depends on the facts and records. An inquiry does not suspend legal deadlines or guarantee that the office will accept the case.
