The course-of-study pathway, educational placement, assessment program, and exit credential should be explained separately. A pathway’s name alone does not show what the student will learn, how progress will be assessed, or what options follow.
Request an individualized analysis
DEPR uses regular, modified, and alternate pathways. Request current rules for the proposed pathway, supporting evaluations, curriculum, supports, promotion criteria, and intended credential. A single score, academic delay, behavior, or missing supports is not a sufficient explanation of the entire decision.
Alternate assessment and family information
The 2026–2027 IEP guide requires documenting family information about alternate standards and their possible effect on regular-diploma requirements. Discuss applicable criteria and the official assessment form. Curriculum and placement must still address needs and the least restrictive environment; a label alone should not promise or rule out all postsecondary study.
What graduating with a diploma means
Under §300.102(a)(3), graduation with a regular high-school diploma can end FAPE eligibility; an attendance or completion certificate does not automatically have that effect. The credential must meet the federal definition rather than merely carry that name. Graduation with a regular diploma is a placement change requiring prior written notice.
When eligibility ends through a regular diploma or exceeding age eligibility, §300.305(e) requires a summary of academic achievement and functional performance with recommendations for postsecondary goals. Review these consequences before accepting an exit determination.
Pathway 1, 2, or 3: examine consequences before agreeing
The Manual describes Pathway 1 as regular; Pathway 2 as modified, with a modified diploma; and Pathway 3 as alternate, with functional-skills certification. These are not equivalent credentials.
Changing pathways can seriously affect curriculum, credentials, and education or employment options. Do not sign agreement until you understand what changes and why. Request relevant evaluations, alternatives with supports, and the specific effect on graduation requirements. If the proposal rests only on low grades, staffing shortages, or school convenience, object in writing and consult an attorney.
This warning does not mean a label irrevocably closes every college opportunity or that a change can never be reviewed. Request the current rule, the specific postsecondary program’s requirements, and what the student would need for a different pathway. SEP, SEM, placement, and pathway labels require individualized analysis rather than substituting for it.
The answer for your situation depends on the facts and records. An inquiry does not suspend legal deadlines or guarantee that the office will accept the case.
