A State complaint seeks investigation of an IDEA violation; due process seeks adjudication of an identification, evaluation, placement, or FAPE dispute. Informal use of “complaint” can describe different procedures: confirm which one is being initiated.

State complaint

Section 300.153 allows an individual or organization to submit a signed written complaint with facts, the alleged violation, and required information. For an individual child, it includes child-specific details and a proposed resolution to the extent known. A copy must simultaneously go to the serving agency. The general rule covers violations within the preceding year.

Section 300.152 provides for a decision within 60 days, with limited extensions. An issue also pending in a due-process hearing is set aside until the hearing concludes. The State agency must resolve a complaint alleging failure to implement a due-process decision.

Due-process complaint

It has pleading, service, deadline, and evidence requirements; Puerto Rico’s Regulation 9168 must be examined. Resolution meetings, mediation, and hearings serve distinct functions. An ordinary school email is not necessarily a proper filing under either procedure.

The answer for your situation depends on the facts and records. An inquiry does not suspend legal deadlines or guarantee that the office will accept the case.
