Parents are members of the IEP team, known as COMPU in Puerto Rico. They must have a real opportunity to provide information, understand options, and participate in decisions. A draft can help; a closed decision that disregards their input can interfere with participation.

Members and roles

Section 300.321 identifies parents; at least one regular-education teacher if the student is or may be in that setting; a special-education teacher or provider; a qualified agency representative; and someone who can interpret the educational implications of evaluations. A person may fill more than one role when the regulatory requirements are met.

Parents or the agency may invite others with knowledge or expertise about the student. The student must be invited when postsecondary goals and transition services will be considered.

Absences, language, and scheduling

Excusing covered members under §300.321(e) requires written agreement or consent as applicable; when their area is discussed, written input before the meeting is also required. Simply announcing an absence is not enough.

Request an interpreter or other communication support in advance. The agency must seek a mutually agreed time and place and ensure that the parent understands the proceedings under §300.322.

If you believe your input is being disregarded

  • Submit questions and information you want discussed.
  • Ask why each important request is accepted or refused.
  • Ask that the disagreement be identified in minutes and the required notice.
  • Keep drafts, the final version, and communications. Disagreement alone does not establish predetermination.

The answer for your situation depends on the facts and records. An inquiry does not suspend legal deadlines or guarantee that the office will accept the case.
