May I record the IEP team meeting?

Special education · Process and next steps

Educational content from the office of Francisco J. Vizcarrondo. Free to read, without registration.

You may request permission, but should not assume every meeting can freely be recorded. The DEPR Manual provides a general rule and exceptions. Address the reason, confidentiality, and how the recording will be preserved.

Rule and exceptions

Section 6.5 of the 2020 Manual, pp. 63–64, addresses recording when everyone agrees and confidentiality is protected; when parents do not understand the language used; or when a permanent or temporary disability affects understanding or note-taking. It also addresses preservation as an education record and limits on disclosure.

How to request it

  • Write to the meeting coordinator promptly after receiving the date.
  • Explain the language, comprehension, or documentation need supporting your request.
  • Request a written response and clarify who will record, preservation, and access.
  • Confirm authorization before recording and document the arrangement in the minutes.

If the request is denied

Ask for the reason and an alternative supporting effective participation. OSEP’s Savit letter, question 2, explains that IDEA does not establish a general recording rule and that policies must allow exceptions needed to understand proceedings or exercise rights. This is interpretive guidance and must be read with Puerto Rico policy. A recording does not replace reviewing the minutes.

Protect confidentiality and explain the need truthfully

Do not claim a nonexistent disability or language barrier to request an exception. Explain the actual need and request a documented response. If authorized, store the recording securely; we recommend not posting it on social media or circulating it to people unconnected with the matter. Consult before disclosing it outside the student’s related proceeding.

The answer for your situation depends on the facts and records. An inquiry does not suspend legal deadlines or guarantee that the office will accept the case.
