Law 238-2004 contains general protections extending beyond the IEP. The linked official text incorporates Law 104-2026. Applying it requires identifying the right and responsible entity.

Equality and access

Article 4 recognizes equality, dignity, and protection against discrimination and retaliation. Article 5 assigns State coordination duties. Section 5(e) requires addressing disability-related service requests within ten business days once requirements are met or necessary documentation is complete.

What this means for an educational request

That period should not be presented as automatic approval of any therapy or as replacing every IDEA deadline. Document the request, when requirements were completed, and the agency’s response.

Prepare the evidence

Keep decisions, communications, and details of the barrier or treatment at issue. We can examine whether the issue concerns educational services, access, discrimination, or another matter and identify the appropriate route.

Favorable interpretation: a duty for DEPR and adjudicative forums too

Article 12 requires liberal interpretation benefiting people with disabilities and favors the more protective provision when laws conflict. Article 15, 1 L.P.R.A. §512k, extends liberal interpretation of legislation concerning their rights to courts, departments, and agencies, including DEPR, its officials applying the law, and administrative forums.

When faced with a restrictive interpretation, expressly invoke these articles and request a written explanation of how the agency considered them. Identify the rule and affected right. This is a legal mandate; applying it to a particular dispute also requires considering evidence, applicable provisions, and constitutional protections. We can help present that argument at the IEP meeting or in the appropriate proceeding.

The answer for your situation depends on the facts and records. An inquiry does not suspend legal deadlines or guarantee that the office will accept the case.
