How can I request my child's education records?

Request access in writing and identify the records: current and earlier IEPs, minutes, evaluations, progress reports, and communications. Identify the student in the request to the agency, ask for acknowledgement, and keep a copy.

IDEA requires access without unnecessary delay, before certain relevant meetings or proceedings, and no later than 45 days after the request. The right to copies depends on circumstances, including whether copies are needed to inspect and review the records. Local rules may add requirements.

List missing records and follow up. A response date requested by the family is different from the federal maximum. Preserve requests, partial deliveries, and responses to allow review of any delay.
