If you disagree with an agency-obtained evaluation, you may request an independent educational evaluation at public expense under IDEA's conditions. Identify the disputed evaluation and keep your request.
Without unnecessary delay, the agency must fund an evaluation under applicable criteria or initiate a hearing to defend its own evaluation. It may ask why you disagree, but cannot require an explanation or improperly delay its response.
Provider selection, qualifications, and agency criteria require review. Puerto Rico's provisional-remedy process may be relevant, but does not create an unlimited right to any provider or fee. Request criteria and procedures before hiring someone in reliance on reimbursement.
