Provide the report to responsible staff and request discussion of the educational needs identified and program changes needed. Considering an evaluation does not mean automatically adopting every recommendation; simply filing it is also insufficient when it identifies needs the IEP must address.

Prepare for discussion

As practical preparation, read the report and ask the evaluator to clarify errors or unfamiliar terms. Submit the version you wish to present, identify your questions, and keep delivery evidence. Request participation by someone able to explain educational implications; coordinate the evaluator’s availability in advance.

Connect each need to the program

Section 300.324 requires consideration of evaluations and appropriate IEP revision for new information or insufficient progress. Identify the performance level, goal, service, support, or accommodation requiring change. If agreed, request documentation in the IEP and an updated copy.

After the annual meeting, parents and the agency may agree to a written amendment without another meeting under §300.324(a)(4) and (6); the team must be informed. This alternative requires agreement and does not authorize unilateral changes.

If a recommendation is rejected

An independent evaluation meeting agency criteria must be considered under §300.502(c). If the agency refuses an evaluation, placement, or FAPE-related change, request the required prior written notice. We can assess whether its explanation addresses the report and documented needs.

Do not let the report simply be filed away

Submit the report and expressly request discussion of identified needs and necessary IEP changes. At the meeting, identify requested goals, services, or supports; ask that the minutes record the response to each point and that you receive the amended IEP. If a FAPE-related change is refused, request prior written notice explaining why.

Considering a report does not automatically approve every recommendation. Nor should lack of formal approval be used to disregard needs already known to the agency: its duty to evaluate and address them must be examined on the facts.

The answer for your situation depends on the facts and records. An inquiry does not suspend legal deadlines or guarantee that the office will accept the case.
