Must the DEPR pay for a private school I choose?

Not automatically. Parent-selected private schooling and private placement at public expense are different situations. Reimbursement requires review of the FAPE offered, appropriateness of the private placement, and equitable considerations.

The federal rule addresses notice to the IEP team at the last meeting before removal or written notice at least ten business days before removal, subject to specific provisions and exceptions. It is not a general rule of ten school days before the school year.

Seek individual advice before removing the student, signing a services plan, or spending money in reliance on reimbursement. Gather the IEP, public offer, minutes, private proposal, costs, and notices. Do not withdraw a complaint or consent based solely on website information.
