Compensatory education addresses educational deprivation. It may require additional services tailored to the effects of a failure; it is not an automatic cash award and is not determined solely by counting sessions.

Document the failure and its effects

Compare the IEP with delivery: service, frequency, duration, dates, and cancellations. Add progress data, regression, skills not acquired, and current needs. Identify whether the agency canceled, the student was absent, or another reason applies; those differences may matter.

An individualized remedy

Discuss which services, intensity, and schedule would address the educational harm. Replacement sessions may be part of the solution, but the remedy is not necessarily identical in every case. Distinguish it from regular services needed going forward.

Extended school year addresses FAPE needs outside the regular calendar. Compensatory education addresses a past deprivation. A student may need both for different reasons.

How to seek relief

Keep a timeline and request a solution in writing. Section 300.151(b) addresses corrective action, including compensatory services or reimbursement, when a failure is found through State complaint procedures. Due process and judicial review have their own requirements. We can assess the procedure and relief based on your records.

The answer for your situation depends on the facts and records. An inquiry does not suspend legal deadlines or guarantee that the office will accept the case.
