FAPE means a free appropriate public education: special education and related services that an eligible student needs, without cost to the family. The central question is whether the program is designed to allow appropriate progress in light of the student's circumstances.
School attendance alone does not answer that question. The IEP should connect identified needs with measurable goals, instruction, supports, and services. Compare evaluations, current performance, the IEP, and progress reports.
Not every disagreement with a school amounts to a denial of FAPE, and a clinical recommendation does not automatically become an IEP service. Educational need, the whole program, family participation, and supporting evidence matter. Identify the need you believe remains unaddressed.
The answer for your situation depends on the facts and records. An inquiry does not suspend legal deadlines or guarantee that the office will accept the case.
